RE: The tariff classification of a battery operated AM/FM clock radio from China.

Dear Ms. Ritchings:

In your letter dated October 9, 2003 you requested a tariff classification ruling.

The item in question is a battery operated AM/FM clock radio with a CD player. This ruling pertains to the model that is in the form of a miniature “Hummer” vehicle. A sample has been submitted that is of a miniature “Volkswagen Beetle” vehicle. It has been indicted that the sample represents the same exact audio features for the model type requested in this ruling. This office will base its classification on those facts. The submitted sample will be returned as requested by Conair Corporation.

The device is a fully functional radiobroadcast receiver capable of receiving radiobroadcasts on either AM or FM channels and it incorporates in the same housing an audio CD player that is not capable of recording. The device also contains a digital alarm clock that displays the time on a self contained LCD screen. The radiobroadcast receiver is capable of operating with an internal source of power (battery operated)

The applicable subheading for the battery operated AM/FM alarm clock radio with a CD player will be 8527.19.5045, Harmonized Tariff Schedule of the United States (HTS), which provides for Reception apparatus for radiotelephony, radiotelegraphy or radiobroadcasting, whether or not combined, in the same housing, with sound recording or reproducing apparatus or a clock: Radiobroadcast receivers capable of operating without an external source of power, including apparatus capable of receiving also radiotelephony or radiotelegraphy: Other: Other: Other. The rate of duty will be 3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
