RE: The tariff classification of a brassiere from Thailand.

Dear Ms. Disher:

In your letter dated October 3, 2003, you requested a tariff classification ruling. The provided sample will be returned as per your request.

Style JB01 is a sports brassiere constructed of a knitted 85% nylon 15% spandex fabric that will be available in large sizes. The garment front has a shelf bra-type inner panel with underwire support and a heavy elasticized bottom band that has a rear adjustable hook and eye closure. Additional features include a scooped neckline, elasticized capping at the top of the brassiere, side seams, and a heavy elastic band measuring approximately 1 inch wide sewn in the bottom hem of the garment.

The applicable subheading for Style JB01 will be 6212.10.9020, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassiere: other: other . . . of man-made fibers. The general rate of duty will be 17 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
