RE: The tariff classification of an accessory for video games from Taiwan

Dear Mr. Daly:

In your letter dated September 4, 2003, you requested a tariff classification ruling, on behalf of Mazzco Inc., your client.

You are requesting the tariff classification on an item that is described as a power supply for video games that are used commercially. The model number for the power supply is 17-PS2-200. A catalog, as well as a sample, has been provided. The catalog corroborates the claim that the product is used in the amusement/game industry. The article will be classified in Chapter 95 of the HTS as parts and accessories for commercial video games. You have not requested the return of your sample.

The applicable subheading for the video game accessory (power supply), model 17-PS2-200, will be 9504.30.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for other games, operated by coins, banknotes (paper currency), discs or other similar articles, other than bowling alley equipment; parts and accessories thereof...parts and accessories. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
