RE: The tariff classification of a child’s handbag with decorations from Hong Kong

Dear Ms. Pembleton:

In your letter dated August 29, 2003, on behalf of ABC Traders, Inc., you requested a tariff classification ruling for a child’s handbag with decorations.

The submitted sample consists of a child’s handbag with attached purse with assorted appliques. It is identified as style #270201, however the sample received is identified as style 265375. It is described as the “Bratz Far Out Fashion Tote”. The handbag is wholly manufactured of man-made fiber textile materials. The handbag is put up for retail sale with a tube of lip gloss and glitter.

The applicable subheading for style 270201 (265375) will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, other, other, of man-made fibers. The rate of duty will be 17.8 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the “Lip Gloss and Glitter”. Your request for a classification ruling should include the use of the glitter; i.e., is glitter applied to lips or other parts of body. Is it used in conjunction with the clear lip gloss? Please provide label or literature indicating the use of all components. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
