RE: The tariff classification of an ABS impulse ring from Italy

Dear Mr. Simpson:

In your letter dated September 8, 2003, on behalf of SKF USA, Inc., you requested a tariff classification ruling.

As indicated by the submitted information, the impulse ring is a toothed wheel made of metal. It is a component of a speed sensor for an automobile anti-lock breaking system (ABS), and is located on the inner ring of a bearing. As the bearing rotates, the sensor counts the wheel teeth that past per second and, in turn, provides a wheel speed reading to the auto’s on-board computer.

The applicable subheading for the ABS impulse ring will be 8543.90.8880, Harmonized Tariff Schedule of the United States (HTS), which provides for electrical machines and apparatus, , not specified or included elsewhere in Chapter 85; parts thereof: Other: Other: Other. The rate of duty will be 2.6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
