RE: The tariff classification of Pooh and Buzz toys in ornament packing from China

Dear Ms. Wang:

In your letter dated August 1, 2003, you requested a tariff classification ruling.

You are requesting the tariff classification on two items that are identified as PVC figurines each packed in a clear plastic ornament /case. The toy figures represent Winnie the Pooh and Buzz Lightning, respectively. The Pooh figure will be classified as a toy while the attached bracelet will be classified as plastic imitation jewelry. The round case/ornament is considered ordinary packing for this item. The Buzz Lightning figure will be classified as a toy in Chapter 95 of the HTS and the case/ornament again will be considered packing for this product. The samples will be returned, as requested.

The applicable subheading for the Pooh toy and the Buzz toy will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for toys representing animals or non-human creatures (for example, robots and monsters) and parts and accessories thereof: other. The rate of duty will be free.

The applicable subheading for the plastic bead bracelet will be 7117.90.7500, Harmonized Tariff Schedule of the United States (HTS), which provides for imitation jewelry: other: of plastics. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
