RE: The tariff classification of a “Dora the Explorer Plush Toy” from China.

Dear Ms. Aldinger:

In your letter dated July 23, 2003, you requested a tariff classification ruling.

You submitted a sample of a “Dora the Explorer Plush Toy” identified as item number 933673. The item is a stuffed “Dora the Explorer” plush doll made of polyester fiber that measures approximately 26 inches in height and is dressed in a black hat, pink shirt, orange shorts, yellow socks, and white and pink shoes. The doll has a two strap purple textile backpack that measures approximately 8 inches in height and 7 inches across that is decorated with a smiling face. The backpack, which is permanently attached to the doll, has a flap and an opening that measures approximately three inches in depth. The backpack has two side pockets, one of which contains a “ruler” that is also decorated with a smiling face.

Your sample is being returned as requested.

The applicable subheading for the “Dora the Explorer Plush Toy” identified as item number 933673 will be 9502.10.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for “Dolls representing only human beings and parts and accessories thereof: Dolls, whether or not dressedStuffed.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
