RE: The tariff classification of handbags from Taiwan

Dear Ms. Meighan

In your letter dated June 19, 2003 you requested a tariff classification ruling.

The first submitted sample, Style 4G914, is a handbag wholly of 100% cotton corduroy fabric. The bag measures approximately 10.5” x 11” and has double self-material handles. The interior is lined and has one zippered wall pocket.

The second sample, Style 4G913, is a messenger style handbag. It measures approximately 9.5” x10”. The bag body is wholly of a 100% polyester faux shearing and has a self-material shoulder strap.

The applicable subheading for item 4G913, handbag of 100% polyester faux shearing will be 4202.22.8050, HTS, which provides, in part, for handbags, whether or not with shoulder strap, including those without handle, of textile materials, with outer surface of textile materials, other, of man-made fibers. The rate of duty will be 17.8 percent ad valorem

The applicable subheading for item 4G914, handbag of 100% cotton corduroy, will be 4202.22.8030, HTS, which provides, in part, for handbags, whether or not with shoulder strap, including those without handle, of textile materials, with outer surface of textile materials, other, of cotton. The rate of duty will be 17.8 percent ad valorem

Goods classified within HTS 4202.22.8030 fall within textile category designation 369. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

Goods classified within HTS 4202.22.8050 fall within textile category designation 370. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

Both samples will be returned as requested.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
