RE: The tariff classification of footwear from China.

Dear Mr.Chu:

In your letter dated June 13, 2003, you requested a tariff classification ruling.

The three submitted samples are described as follows:

(*) Item # 0601DPGBTM is a waterproof, chest-high wading outfit of textile material with 13-inch high rubber/plastics boots attached. The outer sole of the boots have a textile-felt material designed to contact the ground and, we assume, prevent slipping on wet rocks. The applicable subheading for Item # 0601DPGBTM will be 6405.20.90, Harmonized Tariff Schedule of the United States, (HTS) which provides for other footwear with uppers of textile materials, other. The rate of duty will be 12.5 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on Item # 0701DPPBF and Item # 0601DPP. Your request for a classification ruling should include the following:

(**) For Item # 0701DPPBF, describe in complete detail how the product will be finished before retail sale in the United States.

(**) For Item # 0701DPPBF and Item # 0601DPP, indicate whether the items are designed for men’s use. If for unisex use, provide cutting specifications for similarly styled men’s and women’s items. Please note that even if a portion of sales is to women, articles of this type are considered for men if made to men’s cutting specifications.

When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact (*) National Import Specialist Richard Foley at 646-733-3042 or (**) National Import Specialist William Raftery 646-733-3047.

Sincerely,
