RE: The tariff classification of uniform shirts, tops and lab jacket from Vietnam.

Dear Mr./Ms. Gonzalez:

In your letter dated July 7, 2003, on behalf of Strategic Partners DBA, Cherokee Uniforms, you requested a classification ruling. The samples will be returned to you as requested.

Five samples were submitted with your request. Style 80 34 79 23, man’s uniform shirt made of woven 65% polyester/35% cotton blue and white stripe fabric. The shirt has a pointed collar, short sleeves, two breast pockets and a left over right button closure.

Style 78 42 44, men’s uniform shirt made of woven 65% polyester/35% cotton blue fabric. The shirt has a pointed collar, long sleeves, two breast pockets and a left over right button closure.

Style 1866C, women’s woven 100% cotton top with two pockets below the waist, waist level drawstring, V neckline, short sleeves and a full front button closure that closes right over left.

Style 2700C, women’s 100% woven cotton top with two pockets below the waist, a V-neckline, short sleeves and no opening at the back or front.

Style 1373, men’s lab style jacket made of woven 65% polyester/35% cotton fabric. The garment has short sleeves, open neckline with pointed collar, two breast pockets, two pockets below the waist and a full front zipper closure.

The applicable subheading for style 80 34 79 23 will be 6205.30.2050, Harmonized Tariff Schedule of the United States (HTS), which provides for “Men’s or boys’ shirts: Of man-made fibers: Other: Other, Other: With two or more colors in the warp and/or the filling: Men’s.” The duty rate will be 29.3 cents/kg plus 26.1% ad valorem. The textile category designation is 640.

The applicable subheading for style 78 42 44 will be 6205.30.2070, HTS, which provides for “Men’s or boys’ shirts: Of man-made fibers: Other: Other, Other: Other: Men’s.” The duty rate will be 29.3 cents/kg plus 26.1 percent ad valorem. The textile category is 640.

The applicable subheading for styles 1866C and 2700C will be 6211.42.0056, Harmonized Tariff Schedule (HTS), which provides for “Track suits,Other garments, women’s or girls’: Of cotton: Blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206: Other. The rate of duty will be 8.2 percent ad valorem. The textile category designation is 341.

The applicable subheading for style 1373 will be 6211.33.0061, Harmonized Tariff Schedule of the United States (HTS), which provides for “Track suits, ski-suits and swimwear; other garments: Other garments, men's or boys': Of man-made fibers, Other.” The general rate of duty will be 16.1% ad valorem. The textile category is 659.

Based upon international textile trade agreements products of Vietnam for categories 640 and 341 are subject to quota and the requirement of a visa. Laboratory jackets, products of Vietnam in textile category 659 are not subject to quota and a requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
