RE: The tariff classification of Vanox MTI - #53505 (CAS 53988-10-6)

Dear Ms. Scofield:

In your letter dated April 29, 2003, you requested a tariff classification ruling for Vanox MTI (#53505), chemical name - 2-Mercapto-4(5)-Methylbenzimidazole which you have stated is used as an antioxidant and an elastomer.

The applicable subheading will be 2933.99.8290, Harmonized Tariff Schedule of the United States (HTS), which provides for other aromatic heterocyclic compounds with nitrogen hetero-atom(s) only: other. The rate of duty will be 0.4 cents per kilogram plus 7.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
