RE: The tariff classification of a pet carrier from Thailand

Dear Mr. And Ms. Viscome:

In your letter dated May 24th, 2003 you requested a tariff classification ruling.

The sample submitted, identified as a “Mini-Dog carrier”, is a portable pet carrier. Measuring approximately 12”W x 9”H x 9”D, the carrier is constructed with an outer surface primarily of man-made woven textile material. The front of the item is a “door” that features a mesh “window” and is secured by a three-sided zippered enclosure. The back of the sample features an identical “window”. The carrier’s interior is lined with plastic sheeting. A pillow, measuring 8” x 8”, is enclosed in the interior. A plastic carrying handle is attached to the top. The sample will be returned as requested.

You have requested classification within tariff number 6307.90.9889, Harmonized Tariff System of the United States, Annotated (HTSUSA). The provision provides, in part, for other made-up articles of textile and is considered a less specific provision. Articles properly classified in a more specific provision are excluded from classification therein. The containers and cases of heading 4202, HTSUSA are considered more specific and are excluded from heading 6307 by Legal Note.

The applicable subheading for the pet carrier will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides, in part, for other containers, with outer surface of textile materials or of sheeting of plastics, other. The rate of duty will be 17.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
