RE: The tariff classification of Methyl 2,2,2-trichloroacetimidate, CAS # 2533-69-9, imported in bulk form, from Slovakia

Dear Mr. Chivini:

In your letter dated May 15, 2003, you requested a tariff classification ruling.

The subject product, Methyl 2,2,2-trichloroacetimidate, is a nonaromatic, halogenated imine derivative indicated for use as a pharmaceutical intermediate.

The applicable subheading for Methyl 2,2,2-trichloroacetimidate, also known as 2,2,2-trichloroethanimidic acid, methyl ester, will be 2925.20.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for Imines and their derivatives; salts thereof: Other: Other.. The general rate of duty will be 3.7 percent ad valorem.

Articles classifiable under subheading 2925.20.9000, HTS, which are products of Slovakia may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
