RE: The tariff classification of a hand held label printer from Austria

Dear Ms. Bounds:

In your letter dated May 14, 2003, you requested a tariff classification ruling, on behalf of Taxom-USA, your client.

You are requesting the tariff classification on an item that is described as a hand held printer that is used to make pricing labels. The user places a small cartridge into the printer, selects the desired price using the slide mechanisms and then squeezes the printer to manipulate the pins within the cartridge that display the selected price. The cartridge can then be inserted into the shelf clip to display the printed price tag. The proper classification will be in Chapter 96 of the HTS as a device for printing labels. The sample will be returned, as requested.

The applicable subheading for the hand held printer, style 800, will be 9611.00.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for date, sealing or numbering stamps and the like, (including devices for printing or embossing labels), designed for operating in the hand; hand-operated composing sticks and hand printing sets incorporating such composing sticks. The rate of duty will be 2.7 % ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
