RE: The tariff classification of a decorative glass article from China

Dear Ms. Richardson:

In your letter dated May 21, 2003, on behalf of your client, Bed Bath & Beyond, you requested a tariff classification ruling. An illustrative sample was submitted and will be returned to you as requested.

The submitted sample, which is identified as Vendor Item #393026, is a rectangular-shaped, textured, clear glass tray that is decorated with gold painted menorahs, dreidels and Stars of David as well as the words “Happy Hanukah”. There are four small rubber supports (one on each corner) attached to its base. The tray measures approximately fourteen inches by eight inches.

You stated in your letter that this item will be imported in plain glass. You further stated that the unit value of this item will be $2.02.

The applicable subheading for the decorative glass tray will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes: other glassware: other: other: valued over $0.30 but not over $3.00 each. The rate of duty will be 30 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
