RE: The tariff classification of a men’s knit vest from Hong Kong.

Dear Mr. Imbrogulio:

In your letter dated May 9, 2003, you requested a tariff classification ruling. As requested, your sample will be returned.

Style 7931JF115 is a men’s knit vest. The front panel is constructed from a bonded fabric that consists of an outer layer of a 68 percent wool, 32 percent cotton knit fabric with a woven fabric backing. The bonding material is not visible in cross section. The outer layer has the appearance of a fulled knit fabric and measures 22 stitches per two centimeters counted in the horizontal direction. The back panel is constructed from 100 percent wool rib knit fabric that measures 10 stitches per two centimeters counted in the horizontal direction.

Style 7931JF115 is sleeveless and features oversized armholes with woven fabric capping; a stand-up rib knit collar; a full front opening with a zippered closure; vertical welt pockets below the waist; and a rib knit bottom.

In your correspondence, you state that you believe the proper classification for this garment is in subheading 6211.31.0040. As all fabrics In the garment are of knit construction, proper classification is in Chapter 61 as a knit garment.

The applicable heading for Style 7931JF115 will be 6110.11.0050, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of wool: vests, other than sweater vests: men’s or boys’. The rate of duty will be 16.1 per cent ad valorem.

Style 7931JF115 falls within textile category designation 459. Based upon international textile trade agreements, products of Hong Kong are subject to a visa requirement and quota restraints.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
