RE: The tariff classification of a boy’s sleeveless shirt from either Hong Kong or China

Dear Ms. Yost:

In your letter dated April 25, 2003, you requested a tariff classification ruling on behalf of American Public Co.., Inc.

A sample identified as style MEK44IS was submitted and will be returned. You describe the garment as a boy’s sleeveless shirt. It is made of 55 percent ramie and 45 percent cotton woven twill camouflage print fabric. The garment features a left over right full front opening secured shut by five buttons, a stand up collar, two patch pockets located at the bottom of each front panel, two chest pockets with flaps and hook and loop fabric tape for closure, and two small patch pockets located at the shoulder area, above the chest pockets, one to each side. There are two tabs with two buttons to adjust the tightness at the waist. The bottom of the shirt features a straight hem. The bottom shirt hem, the seams around the armholes and around the collar are sewn over with bias tape. This shirt is sized medium.

The applicable subheading for style MEK44IS will be 6211.39.9050, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear, other garments; other garments, men’s or boys’, of other textile materials, other, shirts excluded from heading 6205. The rate of duty will be 2.8 percent ad valorem.

Style MEK44IS falls within textile category designation 840. Based upon international textile trade agreements, products of China and Hong Kong are not subject to quota and do not require a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
