RE: The tariff classification of a jewelry box from China.

Dear Ms. Liu:

In your letter dated April 25, 2003, you requested a classification ruling for a jewelry box.

The sample submitted is identified as item W29F3002. The item is a jewelry box specially fitted on the interior to contain jewelry. The box consists of central top compartment and a bottom pull out drawer. You have requested the proper classification for the jewelry box if manufactured with an exterior surface of 100% cotton and/or 100% man-made fiber textile materials. The box measures approximately 8-½”(W) x 4”(H) x 6”(D). The interior of the box is textile lined and features a fitted mirror within the lid. Your sample is being returned as requested.

The applicable subheading for the jewelry box, item W29F3002, if of cotton will be 4202.92.6091, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases jewelry boxes and similar containers, with outer surface of textile materials, other, of cotton, other. The duty rate will be 6.4 percent ad valorem.

4202.92.6091 falls within textile category designation 369. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

The applicable subheading for the jewelry box if of man-made fibers will be 4202.92.9026 HTS, which provides for trunks, suitcases jewelry boxes and similar containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.8 percent ad valorem.

4202.92.9026 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
