RE: The tariff classification of gloves from China.

Dear Ms. Keller:

In your letter dated April 14, 2003, you requested a tariff classification ruling on behalf of West Chester Holdings, Inc. The provided samples will be returned as per your request.

Five samples were provided for review. Style 35K is a kevlar string-knit glove featuring a ribbed knit cuff with an overlock stitch finish.

Style 35KJYD is a kevlar string-knit glove with a cowhide leather overlay covering the complete palmside from fingertips to wrist and the thumb forefinger crotch. The glove features a ribbed knit cuff with an overlock stitch finish.

Style CMSG#1 is a polyester fleece gauntlet glove. Coated fabric inserts are located at the center of the palm, the lower outer thumb, the middle of the sidewall by the thumb, and at the palmside fingertips of the thumb, the forefinger and a middle finger. Additional features include an elasticized wrist, a hook and clasp, sidewalls and fourchettes, and a hemmed bottom.

Style 2514K is a cut-resistant sleeve made of a knitted kevlar fabric. The item is tubular measuring approximately 13-inches in length with openings on each end.

Style CLGG#1 is a garden glove with a complete palmside and complete thumb constructed of a PVC dot coated knitted cotton fabric. The importer has indicated that the weight breakdown of this fabric is 65% cotton fabric 35% PVC coating. The remaining backside is made of a woven floral printed fabric. The glove features knitted fabric fourchettes, a partially elasticized wrist, and a hemmed bottom.

The applicable subheading for style 35K will be 6116.93.8800, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other: other: without fourchettes. The rate of duty will be 18.7 percent ad valorem.

The applicable subheading for style 35KJYD will be 4203.29.1800, HTS, which provides for Articles of apparel and clothing accessories, of leather or of composition leather: Gloves, mittens and mitts: Other: Other: Other. The rate of duty will be 14 percent ad valorem.

The applicable subheading for style CMSG#1 will be 6116.93.9400, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other: other: with fourchettes. The duty rate will be 18.7 percent ad valorem.

The applicable subheading for style 2514K will be 6117.80.9540, HTS, which provides for "Other made up clothing accessories, knitted or crocheted; knitted or crocheted parts of garments or of clothing accessories: Other accessories: Other: Other, Of man-made fibers: Other." The duty rate will be 14.7% ad valorem.

The applicable subheading for style CLGG#1 will be 6116.10.7510, Harmonized Tariff Schedule of the United States (HTS) , which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: with fourchettes: containing 50 percent or more by weight of cotton, man-made fibers or other textile fibers, or any combination thereof . . . subject to cotton restraints. The duty rate will be 13.3 percent ad valorem.

Style 2514K falls within textile category designation 659. Based upon international textile trade agreements products of China within category designation 659 are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
