RE: The tariff classification of Irinotecan (CAS-97682-44-5), imported in bulk form, from Taiwan

Dear Mr. Hupert:

In your letter dated March 19, 2003, you requested a tariff classification ruling.

The subject product, Irinotecan, is a semisynthetic derivative of Camptothecin, a quinoline-based alkaloid found in the bark of the Chinese camptotheca tree and the Asian nothapodytes tree. Like Topotecan hydrochloride (another semisynthetic derivative of Camptothecin), Irinotecan is also indicated for use as an antineoplastic drug.

The applicable subheading for Irinotecan, imported in bulk form, will be 2939.99.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Vegetable alkaloids, natural or reproduced by synyhesis, and their salts, ethers, esters and other derivatives: Other: Other.” The rate of duty will be free.
