RE: The tariff classification of “Hulk Head Knockers”, item number 234423, from China.

Dear Ms. Santos:

In your letter dated March 18, 2003, you requested a tariff classification ruling.

You are requesting the tariff classification on an item that is described as “Hulk Head Knockers”. The designated item number for this article is 234423. It is a 7-inch resin hand painted “Hulk” bobbing head figurine. When one touches the head of the item it bobbles back and forth. The article will serve as a source of amusement for older children and adults because of the bobbing motion. The hard material of the figurine renders it unsuitable for play by young children. The “Hulk Head Knockers” will be classified in Chapter 95 of the HTS as other toys representing non-human creatures. The sample will be returned, as requested by your office.

The applicable subheading for the “Hulk Head Knockers”, item number 234423, will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for toys representing animals or non-human creaturesand parts and accessories thereof: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
