RE: The tariff classification of a wedding photo album from China or India and stars from China.

Dear Mr. Anderson:

In your letter dated March 28, 2003, on behalf of D56, Village Place, you requested a tariff classification ruling.

The sample submitted is a wedding photo album, item number 56.31042. Also submitted is a photograph depicting assorted stars, item number 56.37554. The wedding photo album is made of two 100 percent polyester woven textile fabric panels. The panels are sewn together. Between the panels is foam padding. The panel’s ends are folded inward and sewn to feature sleeves at either end to create pockets. The wedding photo album is held closed with ribbon ties. The front side is decorated with an applique of a couple dressed in wedding attire and holding an embroidered flower. Around the front edges are plastic beads. The album measures approximately 6-1/2” x 5-1/2”.

The assorted stars are constructed of man-made textile fabric with fiber stuffing material.

You believe that the wedding photo album and stars should be classified in subheading 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), as festive articles. The “Wedding Photo Album” is not used to decorate the house or entertain in the home on a holiday. Weddings have not been recognized as a holiday. Stars are not a symbol of any holiday.

The applicable subheading for the wedding photo album and the assorted stars will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The duty rate will be 7 percent ad valorem.

Articles classifiable under subheading 6307.90.9889, HTS, which are products of India may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB", click on “Files”, click on “Search” and then enter a key word search for the term "T-GSP".

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
