RE: The tariff classification of Benzothiophene-2-Boronic Acid (CAS 98437-23-1) from China.

Dear Mr. Chivini:

In your letter dated April 2, 2003, you requested a tariff classification ruling for Benzothiophene-2-Boronic Acid which you have stated is a pharmaceutical intermediate and will be packaged in bulk form.

The applicable subheading will be 2934.99.4400, Harmonized Tariff Schedule of the United States (HTS), which provides for other aromatic heterocyclic compounds: other. The rate of duty will be 0.4 cents per kilogram plus 7.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
