RE: The tariff classification of tables from China.

Dear Mr. Striebel:

In your letter dated February 28, 2003, you requested a tariff classification ruling.

The submitted photographs depict tables made primarily of a wood top and tubular steel legs. The legs fold in pairs, similar to those of TV tray tables and similar in design to those of banquet tables. The table is intended primarily for indoor use.

The table is a composite good consisting of two different materials. A composite good that is not described in a specific heading is classified according to the material which gives it its essential character. The essential character of the table is imparted by the wood component.

The applicable subheading for the tables will be 9403.60.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Other wooden furniture: Other, Other.” The rate of duty will be free.

You have asked whether this product is subject to antidumping duties or countervailing duties. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
