RE: The tariff classification of baseball viewers from China

Dear Ms. Hickman:

In your letter dated February 26, 2003, on behalf of BWC Global LLC, you requested a tariff classification ruling on baseball viewers from China. A sample of the baseball viewer was submitted with the ruling request.

The submitted sample is identified in your letter as a baseball viewer. The round-shaped article measures approximately 3 inches in diameter and features the leather exterior of a baseball with an underside of plastic, and a hollow interior. The name “ImageBall” is printed in red lettering on the left side of the article. The ImageBall features a hole in the front of the exterior that measures approximately ½ of an inch in diameter and that has been fitted with a single lens for viewing a slide. The ImageBall has an opening in the back of the exterior that will be used to place a slide for viewing through the lens in the article.

The applicable subheading for the baseball viewers will be 9013.80.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for other optical appliances and instruments, not specified or included elsewhere in this chapter; other. The rate of duty will be 4.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
