RE: The tariff classification of nonwoven cleaning cloths of a hydroentangled spunlace construction, from China.

Dear Mr. Hoffacker:

In your letter dated March 6, 2003, on behalf of Best Brands Home Products, Inc., New York, NY, you requested a tariff classification ruling.

Your sample is being returned as requested.

You submitted a retail package containing six reusable cleaning cloths which are identified in your letter as Item# WM40015. These cleaning cloths measure 21" x 11" (53 cm x 28 cm) and are composed of a 90% rayon/10% polyester man-made fiber blend (staple). These cloths are of a hydronentangled (spunlace) nonwoven construction and are stated to weigh 50 g/m². According to the header on the instant sample package, they have multiple uses and are reusable and machine washable.

The applicable subheading for the cloths will be 5603.92.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for nonwovens, whether or not impregnated, coated, covered or laminated, of other than filaments, weighing more than 25 g/m² but less than 70 g/m². The duty rate will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
