RE: The tariff classification of printed circuit boards from China

Dear Ms. Dawson:

In your letter dated February 21, 2003 you requested a tariff classification ruling.

As indicated by the submitted samples, there are two circuit boards in question. Both of the boards are used in the manufacture of a Travelite Baby Swing. Item IMP05900 controls the motor on the swing and consists of a printed circuit board containing a rotary switch, connectors and several other electronic components. Item IMP05905 controls the lights and music feature of the swing and consists of two printed circuit boards wired together that contain four push-button switches and several insulated conductors with LED’s connected to the ends.

The applicable subheading for the printed circuit boards, items IMP05900 and IMP05905, will be 8537.10.9070, Harmonized Tariff Schedule of the United States (HTS), which provides for other boards, panels, , and other bases, , for electric control or the distribution of electricity, : For a voltage not exceeding 1,000 V. The rate of duty will be 2.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
