RE: The tariff classification of acrylic and polyurethane dispersions from Canada.

Dear Ms. Meunier:

In your letter dated February 4, 2003 you requested a tariff classification ruling.

Anti-Graffiti Barrier by Egalab Inc. is described as an acrylic dispersion in water containing solvent and hardener for use as a protective coating that prevents dust and oil from penetrating aged concrete.

Stall Guard by Neo Resins Inc. is described as a polyurethane dispersion in water containing solvent and hardener for use as a protective coating that prevents graffiti paint from penetrating into the pores of the partition.

The applicable subheading for the acrylic dispersion will be 3906.90.2000, HTSUS, which provides for other plastic acrylic polymers. The rate of duty is 6.3 % ad valorem.

The applicable subheading for the polyurethane dispersion will be 3909.50.5000, HTSUS, which provides for other polyurethanes. The rate of duty is 6.3 % ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
