RE: The tariff classification of a tote bag from China.

Dear Ms. Kwok:

In your letter dated January 30, 2003, you requested a tariff classification ruling for a tote bag.

A sample of item C3-79631A-1 has been submitted. The item is a double handle, open top tote bag designed to contain personal effect and accessories on a daily basis. It is manufactured with an exterior surface of 100% polyester that has a suede-like appearance. The interior is vinyl lined with a zippered back wall pocket. The bag measures approximately 20”(W) x 12”(H) with a 6” base.

The applicable subheading for the tote bag will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The rate of duty will be 17.8 percent ad valorem.

You have asked whether this product is subject to antidumping duties or countervailing duties. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
