RE: The tariff classification of impellers from an unknown country

Dear Ms. Vybiral:

In your letters dated Oct. 24, 2002 and January 13, 2003 you requested a tariff classification ruling.

The impellers are metal 4-bladed propellers which are used in laboratory stirred reactor pressure vessels. They will be mounted on solid or hollow metal shafts which will be attached to a MagneDrive® agitator to form a mechanical rotation system for the mixing of gases, liquids, and fluids with solids suspensions. Literature submitted with your inquiries describes three types of impellers: Dispersimax, straight blade, and pitched blade. The Dispersimax is a turbine-type impeller which is designed for gas/liquid reactions. As it is rotated it provides radial flow, while simultaneously drawing a gas down through the hollow shaft and dispersing it for effective high speed stirring. The straight blade turbine is also designed for gas/liquid applications, and is particularly suited for mixing applications requiring high shear at high speeds. The axial flow or pitched blade turbine impeller features blades pitched at a 45 degree angle, thus making it especially useful for high speed liquid/solid mixing applications.

For purposes of this ruling we assume the impellers will be manufactured in a country entitled to the duty rates listed in the General Rates of Duty column in the Harmonized Tariff Schedule of the United States (HTS). The applicable subheading for the impellers will be 8479.90.9495, HTS, which provides for parts of machines and mechanical appliances having individual functions, not specified or included elsewhere (in chapter 84): other: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
