RE: The tariff classification of a costume from Mexico.

Dear Ms. Rogalski:

In your letter dated January 13, 2003, you requested a classification ruling. As requested, the sample will be returned to you.

Your submitted sample, style 1192 Renaissance King is an uni-sex costume. The costume consists of a well-made polyester knit pullover garment that simulates a sweater over a tank top. The pullover is constructed from a knit polyester panne material (the inner front panel, leg of mutton long sleeves) and knit polyester satin material that forms the back panel and two front outer panels). The sleeves and front outer panels are attached to the pullover at the shoulders and the sides. The outer front panels have a full opening fastened with a ribbon tie. The pullover has a satin ruffle around the neckline and at the bottom of the long sleeves.

The applicable subheading for style 1192 will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other, other: women’s or girls’. The general duty rate will be 32.2 percent ad valorem.

The product is not subject to quota or visa requirements from Mexico.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
