RE: The tariff classification of a color production system from the Netherlands.

Dear Mr. Driessen:

In your letter dated December 16, 2002, you requested a tariff classification ruling.

The merchandise under consideration is the Océ CPS 700 color production system. The CPS 700 is a stand-alone multifunctional seven-color production system that combines a printer, scanner and copier based upon the Océ Color Copy-Press technology. The Color Copy-Press technology is based upon a magnetic process rather than an electrostatic process. This is a “Direct Imaging (DI) Technology.” For each of the seven basic colors there is one DI-drum, the seven color toner images are compiled on the transfer drum after which the complete full-color image is transferred and fused onto the paper in one single step. This system is imported in its entire configuration with a digital controller for network printing. The CPS 700 is a short-run digital color printing system that produces a digital output of 400x1600 dpi, and is capable of printing up to 25 pages per minute. This system is designed as a production machine for the “print for pay” market and for central reprographic environments. It is not designed for use as an office or workgroup printer.

The applicable subheading for the Océ CPS 700 color production system will be 8472.90.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other office machinesOther: Printing machines other than those of heading 8443 or 8471.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
