RE: The tariff classification of carrying bags, dolls, and toys from China.

Dear Ms. Kittel:

In your letter dated December 18, 2002, you requested a tariff classification ruling.

You submitted the following samples:

Item #62369, Baby I’m Yours™ “Baby Bundles”, consists of an 8” plastic doll packaged inside a clear vinyl bag. The doll is wearing a pink hat and dressed in a sleeper that is wrapped in a triangular shaped fabric blanket. The doll’s torso, arms and legs are made of fabric and stuffed with polyester. The bag is cylindrical shaped with a pink fabric top and measures approximately 9 inches in height and 4-1/2 inches in diameter. The bag does not have a handle or straps and therefore appears to have little utilitarian use outside of normal packaging for the doll.

Item #63043, Baby I’m Yours™ “Baby with Travel Bag”, consists of an 11” plastic doll dressed in a pink sleeper and wearing a pink hat packaged with various toys inside a carrying bag with adjustable shoulder strap and drawstring top. The toys include 1 bottle, 1 sipper cup, 1 juice box, 1 baby food jar, 1 diaper wipes container, 1 bear, 1 elephant, and 1 rattle, all made of plastic. The carrying bag is wholly made of plastic sheeting and is of the kind similar to a travel/toiletry bag designed to contain personal effects during travel and, therefore, will be classified separately from the doll and toys.

Item #63235, Baby I’m Yours™ “Baby Sisters Travel Set”, consists of three 7” plastic dolls dressed in fabric sleepers and hats packaged with various toys inside a zippered carrying bag with a handle on top. The toys include 1 plastic wet wipe container, 2 plastic baby food jars, 3 cardboard boxes of fake food, and 1 plastic elephant. The carrying bag is wholly made of plastic sheeting and is of the kind similar to a travel/toiletry bag designed to contain personal effects during travel and, therefore, will be classified separately from the doll and toys.

The applicable subheading for the carrying bags of Item #63043 and Item #63235 will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Travel, sports and similar bags: With outer surface of sheeting of plastic or of textile materials: Other.” The rate of duty will be 20 percent ad valorem

The applicable subheading for the doll and bag of Item #62369 will be 9502.10.0010, HTS, which provides for “Dolls representing only human beings and parts and accessories thereof: Dolls, whether or not dressedStuffed.” The rate of duty will be free.

The applicable subheading for the dolls of Item #63043 and Item #63235 will be 9502.10.0060, HTS, which provides for “Dolls representing only human beings and parts and accessories thereof: Dolls, whether or not dressedOther.” The rate of duty will be free.

The applicable subheading for the bear and elephant toy of Item #63043 and the elephant toy of Item #63235 will be 9503.49.0000, HTS, which provides for “Toys representing animals or non-human creatures (for example, robots and monsters) and parts and accessories thereof: Other.” The rate of duty will be free.

The applicable subheading for the toys (1 bottle, 1 sipper cup, 1 juice box, 1 baby food jar, 1 diaper wipes container, and 1 rattle) of Item #63043 and the toys (1 plastic wet wipe container, 2 plastic baby food jars, and 3 cardboard boxes of fake food) of Item #63235 will be 9503.90.0080, HTS, which provides for “Other toys; reduced-size ("scale") models and similar recreational models, working or not; puzzles of all kinds; parts and accessories thereof: Other: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
