RE: The tariff classification of an umbrella from China.

Dear Mr. Lindaman:

In your letter dated December 20, 2002 you requested a tariff classification ruling. The item, a “Porta Roof” camouflage design hunting umbrella has been the subject of rulings NY I84891, dated August 14, 2002 and NY I86766, dated November 6, 2002. You have informed this office that you have redesigned the umbrella, which is the reason for this ruling.

The submitted sample is a “Porta Roof” camouflage design hunting umbrella. The umbrella is foldable and is mounted to a tree trunk. Two fabric panels unfurl to create a V-shaped umbrella that fits around a tree and is secured at the top with three sets of ribbons that are sewn onto the panel edges. A rod that extends from the tree trunk to the umbrella shaft secures the bottom of the umbrella. The umbrella shaft, which contains an approximately 3 ½ inch telescopic element, is inserted into the rod after the umbrella is opened.

The applicable subheading for the “Porta Roof” camouflage design hunting umbrella will be 6601.91.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “UmbrellasOther: Having a telescopic shaft.” The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
