RE: The tariff classification of a Minnie Mouse “It’s A Girl” stuffed toy and a baby blanket from China.

Dear Ms. Wang:

In your letter dated December 11, 2002, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that is comprised of a stuffed Minnie Mouse toy and a baby blanket. You identify the product as a Minnie “It’s A Girl” Baby Gram with Blanket. The Minnie Mouse toy is dressed in a pink diaper and a short shirt with a sewn-on hat embroidered with “It’s a Girl!” The blanket is a plush, pink baby blanket, trimmed with satin edging. You state in your letter that the blanket, embroidered with the baby’s name, will be sewn onto the plush toy, after the order is placed. Regardless of whether the blanket is imported attached to the toy or simply packaged with the toy, it will be classified separately as a blanket in Chapter 63 of the HTSUSA. The stuffed toy, of course, will be classified in Chapter 95 of the HTSUSA as a stuffed toy. The samples will be returned, as requested by your office.

The applicable subheading for the Minnie Mouse stuffed toy will be 9503.41.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for toys representing animalsand parts and accessories thereof: Stuffed toys and parts and accessories thereof. The rate of duty will be free.

The applicable subheading for the woven baby blanket will be 6301.40.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for blankets (other than electric blankets) and traveling rugs, of synthetic fiberswoven. The present rate of duty will be 9.4 % ad valorem.

The 2003 rate of duty for the woven baby blanket will be 9 % ad valorem.

The baby blanket falls within textile category designation 666. Based upon international textile trade agreements products of China may be subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
