RE: The tariff classification of drill bits and a chuck from Taiwan

Dear Ms. Lam:

In your letter dated December 4, 2002 you requested a tariff classification ruling.

In addition to product literature, you have provided a sample of the chuck and a mill certificate for the drill bits. The drill bits and chuck will be used with a non-electric hand crank drill. The handle and drill housing (not imported) will be made in the U.S. and sold with the bits and chuck. The drill bits are made of high speed steel (HSS) while the chuck is made of chrome plated steel.

The applicable subheading for the drill bits will be 8207.50.2055, Harmonized Tariff Schedule of the United States (HTS), which provides for interchangeable tools for handtools, whether or not power-operated : tools for drilling, other than rock drilling, and parts thereof: with cutting part containing by weight over 0.2 percent of chromium, molybdenum, or tungsten or over 0.1 percent of vanadium. The rate of duty will be 5 percent.

The applicable subheading for the chuck will be 8466.10.8075, HTS, which provides for tool holders for any type of tool for working in the hand: tool holders and self-opening die heads: other. The rate of duty will be 3.9 percent.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
