RE: The tariff classification of a men’s knit jacket and a safety vest from China.

Dear Ms. Milling:

In your letter dated November 26, 2002, you requested a tariff classification ruling. As requested, your samples will be returned.

Item code # 88-64-33 is identified as a “Men’s Camouflage Fleece Jacket.” The jacket is constructed from 100 percent polyester, finely knit fabric that is napped on the inside and outside surfaces. The garment has a self-fabric hood with a drawstring; a full front opening with a zippered closure; pouch pockets below the waist; and a snug fitting rib knit bottom.

Item code # 80-09-18 is identified as an “Orange Oxford Safety Vest.” You state that the safety vest is constructed from knit polyester fabric. Examination reveals that the item is constructed from woven polyester fabric. The safety vest is imported as “one size fits all” and has a full front opening with tie string closures and full side openings with two elastic strips near the waist that serve to join the front and back panels.

The applicable subheading for Item code # 88-64-33 will be 6101.30.2010, Harmonized Tariff Schedule of the United States, (HTS), which provides for: men’s or boys’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers, and similar articles, knitted or crocheted: other than those of heading 6103: of man-made fibers: other: men's. The rate of duty is 28.6 percent ad valorem. Effective January 1,2003, the rate of duty will be 28.4 percent ad valorem

The applicable subheading for Item code # 80-09-18 will be 6217.10.9530, Harmonized Tariff Schedule of the United States, (HTS), which provides for: other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: other: of man made fibers. The rate of duty is 14.8 percent ad valorem. Effective January 1, 2003, the rate of duty will be 14.7 percent ad valorem

Item code # 88-64-33 falls within textile category designation 634. Item code # 80-09-18 falls within textile category designation 659. Based upon international textile trade agreements, products of China are subject to visa requirements and quota restraints.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
