RE: The tariff classification of Pure Chocolate Medallions from Turkey

Dear Mr. Hamelin:

In your letter dated November 26, 2002, on behalf of Les Aliments Papco Inc., you requested a tariff classification ruling.

A sample was submitted with your request. The subject merchandise consists of confectionery in the form of chocolate medallions. The ingredients on the product label are: sugar, cocoa oil, whole milk powder, cocoa liquor, lecithin and vanillin. The chocolate medallions are individually wrapped in gold foil, and are packaged for retail sale inside a clear plastic wrap.

The applicable subheading for the Pure Chocolate Medallions will be 1806.90.9019, HTS, which provides for Chocolate and other food preparations containing cocoa...other...other...other... confectionery...other. The rate of duty will be 6 percent ad valorem.

Articles classifiable under subheading 1806.90.9019, HTS, which are products of Turkey may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB", click on “Files”, click on “Search” and then enter a key word search for the term "T-GSP".

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
