RE: The tariff classification of a cellular phone holder from China.

Dear Ms. Kwok:

In your letter dated November 8, 2002, you requested a tariff classification ruling for a cellular phone holder.

The sample submitted is identified as “Red Checker Pattern Nylon Cell Phone Case”, item #C-75591. The item is a carry case specially designed and fitted to contain a cellular phone. It is manufactured with an exterior surface of 100% nylon woven textile material. It measures approximately 6”(H) x 2 ¾”(W) with 1 ½”gussets. The case features a rear textile belt loop that is held in place by means of a hook and loop fastener, in addition to a molded plastic dog leash-type hook. When not in use as a belt loop, the item converts to a carrying strap. The holder is secured by means of a flap with a hook and loop fastener.

The applicable subheading for Item C-75591 will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides in part, for other bags and containers, with outer surface of textile materials, other, other, other, of man-made fibers. The rate of duty will be 18.1 percent ad valorem.

You have asked whether this product is subject to antidumping duties or countervailing duties.
