RE: The tariff classification of a glass article from Germany

Dear Ms. Woodward:

In your letter dated November 1, 2002, you requested a tariff classification ruling. A representative sample of the item was submitted with your ruling request.

The subject article, which is described as a glass popcorn maker, consists of a large clear glass bowl and a clear glass dome-shaped cover with a round glass-lifting knob on top. The bowl measures approximately four inches in height and ten and one-half inches in diameter at the opening and five inches in diameter at its base. The glass dome cover, which measures approximately seven inches in diameter, is designed to fit inside the glass bowl.

You stated in your letter that the unit value of this item is approximately $8.18.

The applicable subheading for the glass popcorn maker will be 7013.39.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for table or kitchen purposesother: other: other: valued over $5 each. The rate of duty will be 7.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
