RE: The tariff classification of a cross bar transfer system from Switzerland

Dear Mr. Allen:

In your letter dated Oct 23, 2002 on behalf of Aida Dayton Technologies Corp. you requested a tariff classification ruling.

The Gudel cross bar transfer system is used to automate the feeding, handling, stacking and destacking operations of stamping presses and tandem press lines. According to a quotation submitted with your inquiry, the transfer system will consist of the following components:

Two Gudel electrotransfer systems, each consisting of two closing and four lifting units for mounting onto the press uprights;

One Gudel PL-1/RS blank loader system, consisting of a blank loader and two blank carts to allow blank stack change without stopping the press;

Two Gudel LUF-1 loading/unloading feeders to pick up parts from the exit blank nest and place them onto an interpress shuttle table or exit conveyor;

One Gudel ST-1 interpress shuttle table to transfer the parts from the unloading feeder of one press to the loading feeder of another press;

One Gudel SDS-1/FL combined panel stacking and blank destacking system consisting of a cross-shuttle table, a stacking/destacking feeder, two beam mounted overhead loading robots, and two finished parts cart circulating/storage systems with integrated rail and drive mechanism;

Two parts nest carts operating with the presses for automatic part changes;

Two optional removable exit conveyors.

For purposes of this ruling, it is assumed that the stamping presses are not imported with the cross bar transfer system.

The applicable subheading for the Gudel cross bar transfer system described above, imported together in a single shipment, will be 8428.90.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for other lifting, handling, loading or unloading machinery: other machinery: other: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
