RE: The tariff classification of agitators, shafts and impellers of unknown origin.

Dear Ms. Vybiral:

In your letter dated October 24, 2002 you requested a tariff classification ruling on behalf of Snap-tite.

The articles in question are identified as agitators, identified by the trade name “MagneDrive”, shafts and impellers. The agitators are devices used in conjunction with the shafts and impellers to mix various materials within a pressure vessel. Descriptive literature was submitted.

The “MagneDrive” is a closed mechanical system with seals that allow torque to be transferred from an external source into a sealed vessel. The “MagneDrive” uses outer drive magnets, rotated by a motor-driven belt, to exert powerful attraction on an encapsulated inner magnet assembly. As the outer drive magnets are rotated, torque is transferred to the inner magnets, resulting in rotation of an output shaft. The shafts used with the “MagneDrives” allow impellers or various design to be attached to the agitator and transmit torque from the “MagneDrive” to the impeller. “MagneDrives” are presented without shafts or impellers, allowing for customization of shaft length and impeller style.

The applicable subheading for the “MagneDrives” and the shafts, whether or not separately presented, will be 8483.10.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other transmission shafts and cranks. The rate of duty is free.

Your inquiry does not provide enough information for us to give a classification ruling on separately imported impellers. Your request for a classification ruling should include a statement as to whether the various types of impellers can be used with mixing machines other than the laboratory stirred reactors depicted in the literature submitted. If not, please indicate why they are physically incapable of use with other mixing machines. When this information is available, you may wish to consider resubmission of your request.
