RE: The tariff classification of women’s knit garments from China.

Dear Mr. McGeary:

In your letter dated October 4, 2002, on behalf of your client Arco Holdings, you requested a tariff classification ruling.

The submitted samples are described as follows:

Style #5036 – comprised of two garments. A pair of women’s knit pants and a knit pullover. The pants are constructed from 80% cotton, 20% polyester knit fabric, and feature an elasticized waistband with a drawstring, a left front patch pocket, and tubular knit leg opening. The pullover is constructed from 80% cotton, 20% polyester knit fabric and features long sleeves with rib knit cuffs, a scoop neckline, two front pockets at the waist, and a wide tubular knit bottom.

Style #5035 – comprised of two garments. A pair of women’s knit shorts and a woman’s knit halter top. The shorts are constructed from 80% cotton, 20% polyester knit fabric and feature an elasticized waistband, a front zipper opening with a button closure, and hemmed leg openings. The halter top is constructed from 80% cotton, 20% polyester knit fabric. The garment extends below the waist and features a high neckline, wide straps that tie around the neck, and a tubular knit bottom. The garment does not provide shoulder or upper back coverage.

Style #5024 - a woman’s pullover constructed from 100% cotton, knit fabric. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the horizontal direction. The garment features a round neckline, short capped sleeves, and a hemmed bottom. Style #5025 - a woman’s sleeveless pullover constructed from 100% cotton, knit fabric. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the horizontal direction. The garment features a modified V- neckline, and a hemmed bottom. The armholes are finished with knit capping.

Style #5030 - is comprised of two garments. A woman’s cardigan and dress. The cardigan is constructed from 80% cotton, 20% polyester, brushed knit fabric. The outer surface measures more than 9 stitches per 2 centimeters in the horizontal direction. The cardigan features a hood, long sleeves with self-fabric cuffs, a full front opening with a zipper closure, 2 front pouch pockets at the waist, and a self-fabric bottom. The tube style dress features spaghetti straps that tie at the top of the shoulders, an elasticized top edge, gathering in the center chest area, and a tubular knit bottom.

The applicable subheading for the pants, Style 5036, will be 6104.62.2011 Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ trousers, knitted or crocheted, of cotton, other, trousers, women’s, other. The rate of duty will be 15.3% ad valorem.

Style 5036, falls within textile category designation 348. Based upon international textile trade agreements this category, from China is subject to visa requirements and quota restraints.

The applicable subheading for Styles 5036, 5024, 5025, (Pullovers) & 5030 (Cardigan), will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts and similar articles, knitted or crocheted, of cotton, other, other, women’s or girls’. The rate of duty will be 17.3% ad valorem.

Styles 5036, 5024, 5025, & 5030, fall within textile category designation 339. Based upon international textile trade agreements this category, from China is subject to visa requirements and quota restraints.

The applicable subheading for Style 5030 (Dress), will be 6104.42.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s dresses, knitted or crocheted, dresses, of cotton, women’s. The rate of duty will be 11.6% ad valorem.

Style 5030 (Dress), falls within textile category designation 336. Based upon international textile trade agreements this category, from China is subject to visa requirements and quota restraints.

The applicable subheading for Style 5035 (Shorts), will be 6104.62.2030, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s shorts, knitted or crocheted, of cotton, shorts, women’s. The rate of duty will be 15.3% ad valorem.

Style 5035 (Shorts), falls within textile category designation 348. Based upon international textile trade agreements this category, from China is subject to visa requirements and quota restraints.

The applicable subheading for Style 5035 (Halter Top), will be 6114.20.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted, of cotton, tops, women’s. The rate of duty will be 10.9% ad valorem.

Style 5035 (Halter Top), falls within textile category designation 339. Based upon international textile trade agreements this category, from China is subject to visa requirements and quota restraints.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
