RE: The tariff classification of a glass bowl with eight tealight holders from China

Dear Ms. Aldinger:

In your letter dated October 25, 2002, you requested a tariff classification ruling.

The submitted sample, item 930548, is a composite article consisting of a 12.6 inch glass bowl with a 4 inch ledge around the edge that holds eight removable glass cone shaped tealight candleholders. The candles are not included. The intended use of the item is as a decorative bowl/candleholder. Since neither the bowl nor the candleholders impart the essential character, the composite article is classified based on the heading that occurs last in numerical order among those which equally merit consideration.

The applicable subheading for the glass candleholder, item 930548, will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
