RE: The tariff classification of safety glasses made in Taiwan

Dear Mr. Chapman:

In your letter dated October 1, 2002, you requested a tariff classification ruling on safety glasses made in Taiwan. You have submitted product sheets for Visiball Safety Glasses for model numbers V-100, V-200 and V-300. You have indicated in your letter that you do not have the product sheets for model numbers V-400 and V-500. Samples of the safety glasses were not furnished with your request for a ruling

The safety glasses for which you are requesting a ruling are identified in your letter as Visiball model numbers V-100, V-200, V-300, V-400 and V-500. The Visiball Safety Glasses feature wrap-around plastic frames and impact resistant non-prescription polycarbonate lenses which provide 99.9 percent ultra violet (UV) protection. The lenses are available in clear, smoke, amber, vermilion and mirror. You have indicated in your letter that Visiball model numbers V-400 and V-500 are designed to be worn over another pair of glasses.

The applicable subheading for the safety glasses will be 9004.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for spectacles, goggles, and the like, corrective, protective or other; other. The rate of duty will be 2.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
