RE: The tariff classification of a framed glass mirror from China

Dear Ms. Peirce:

In your letter dated October 7, 2002, you requested a tariff classification ruling. A photograph and a diagram of the product were submitted with your ruling request.

The subject article, which is identified as “1927MR/MF1309” – Oval Mirror, is an oval-shaped swivel glass mirror in a wooden frame. The mirror is attached to a small wooden drawer. The item is designed to sit on a bureau or vanity.

You indicated in your letter that the approximate outside dimensions of the unit are 20.28 inches in height by 13.52 inches in width by 5.79 inches in depth. The reflective surface is 35.4 cm in height by 22.8 cm in width, which is an area of 633.91 centimeters square.

The applicable subheading for the framed glass mirror will be 7009.92.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for glass mirrors, whether or not framed, including rear-view mirrors: framed: not over 929 cm² in reflecting area. The rate of duty will be 7.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
