RE: The tariff classification of ladies handbags from China

Dear Mr. Spano:

In your letter dated October 2nd, 2002 you requested a tariff classification ruling. The request is on behalf of Kenneth Cole Productions L.P.

The first sample submitted, identified as Style #HR91040FB, is a lady’s handbag that measures approximately 12 1/2”W x 8 ¾”H x 40 3/4”D, the external body is mainly of a lattice work fabric consisting of interlaced strips of polyethylene straw, plastic strips, and narrow fabrics of cotton textile material. The polyethylene straw and plastic strips are each 6-mm in width. The bag has a fabric lining and top zipper closure. The zipper collar, edging, handles, and bottom panel are each of a woven cotton fabric.

The second sample is identified as Style #HR90790FB. It is a lady’s handbag that measures approximately 11”W x 9 ½”H x 5”D. The exterior main body of the bag consists of parallel rows of narrow fabrics of man-made textile materials and polypropylene (PP) straw (with an apparent width of less than 5mm). The latter PP straw is considered a man-made textile material for tariff purposes. The handle straps, trim, zipper collar and bottom are of a cotton fabric. The handbag also features a zippered top enclosure and full cotton denim handles, trim and base. The interior of the bag is lined.

The samples will be returned.

The applicable subheading for Style HR90790FB will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, other, of man-made fibers. The rate of duty will be 18.1 percent ad valorem.

We are unable to issue a classification ruling for style HR91040FB. because we need additional information. Please submit the additional information indicated below:

Breakdown of component materials by weight, value and quantity in terms of inches of each component of the lattice work, i.e. the polyethylene straw, the plastic strips and the narrow fabric. Cost of sponge vinyl lattice work backing

Breakdown by value for each component of the handbag, i.e. the latticework, handles, zipper collar, trim, bottom, lining zippers and fittings.
