RE: The tariff classification of a Butterfly Easter Organizer from China.

Dear Ms. Davenport:

In your letter dated October 3, 2002, you requested a tariff classification ruling.

The submitted sample is called a Butterfly Easter Organizer, style 063. The product consists of a plastic tray in the shape of a butterfly that holds the following: 8 different foam stamps, 2 ink pads, assorted bead sets with a clear string and a ball chain with a plastic butterfly attached. The organizer is a generic butterfly, and not a festive article. Since the items do not comprise a set for the purposes of the HTS (the individual pieces are not put up for the same purpose) all the parts must be classified separately. The samples will be returned, as requested.

The applicable subheading for the 8 foam stamps will be 9611.00.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for date, sealing or numbering stamps and the like...designed for operating in the hand; hand-operated composing sticks and hand printing sets incorporating such composing sticks. The rate of duty will be 2.7 % ad valorem.

The applicable subheading for the 2 ink pads will be 9612.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for ink pads. The rate of duty will be 3.5 % ad valorem.

The applicable subheading for the erasers, if composed of rubber, will be 4016.92.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of vulcanized rubber other than hard rubber, erasers. The rate of duty will be 4.2 % ad valorem.

The applicable subheading for the erasers, if composed of plastic, will be 3926.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics, office or school supplies. The rate of duty will be 5.3 % ad valorem.

The applicable subheading for the assorted beads set with string will be 3926.90.3500, Harmonized Tariff Schedule of the United States (HTS), which provides for beads, bugles and spangles, not strungand not set; articles thereof, not elsewhere specified or included: other. The rate of duty will be 6.5 % ad valorem.

The applicable subheading for the butterfly ball chain will be 7315.89.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for chain and parts thereof, of iron or steel, other chain, other, other. The rate of duty will be 3.9 % ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
