RE: The tariff classification of five framed glass mirrors from China

Dear Mr. Griffith:

In your letter dated September 25, 2002, you requested a tariff classification ruling regarding three “visor” mirrors and two “blind spot” mirrors. Five representative samples were submitted with your ruling.

Item #9120 is a large removable visor glass mirror in a black plastic frame. The reflecting surface area measures approximately eight and one-quarter inches in width by three and one-half inches in height. The item features a “Velcro” type hook and loop tape which allows for fast removal and replacement of the mirror. It also has a slip-on elastic strap that fits over a car visor.

Item #8237 is a small removable visor glass mirror in a black plastic frame. The reflecting surface area measures approximately five inches in width by three inches in height. The item is designed with a “Velcro” type hook and loop tape which allows for fast removal and replacement of the mirror.

Item #9100 is a small visor glass mirror in a black plastic frame. The reflecting surface area measures approximately five and one-quarter inches in width by three and one-quarter inches in height. The item is designed with pressure sensitive tape and a slip-on elastic strap that fits over a car visor.

Item #8222 is a two-inch “blind spot” convex glass mirror in a black plastic frame. You indicated in your letter that this mirror is used for wide-angle viewing in auto or home. The item is designed with pressure sensitive tape.

Item #8247 is a three and three-quarter inch “blind spot” convex glass mirror in a metal frame. You stated in your letter that this type of mirror is used for wide-angle viewing in auto or home. The item is designed with pressure sensitive tape.

The applicable subheading for the five framed glass mirrors will be 7009.92.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for glass mirrors, whether or not framed: framed: not over 929 cm² in reflecting area. The rate of duty will be 7.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
