RE: The tariff classification of a shower curtain, rubber mat, shower curtain hooks and curtain tension rod from China.

Dear Mr. Walton:

In your letter dated September 13, 2002 you requested a classification ruling.

You submitted four samples. Item 64953 is a textile shower curtain. The curtain is made from 100 percent polyester woven fabric. It measures 70 x 72 inches. Three sides are hemmed. The top of the curtain has 12 metal grommets used for the placement of the shower curtain hooks.

Item 64954 is a tub mat. The mat is made from 100 percent rubber. It measures 16 x 28 inches. The back of the mat features suction cups used to affix the item a bathtub.

Item 64416 is a decorative shower curtain hook. The hook is comprised of a steel metal hook with a decorative polyresin button.

Item 64956 is a steel tension rod for curtains. The rod measures 37 x 70 inches.

The applicable subheading for the shower curtain will be 6303.92.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for curtains (including drapes) and interior blinds; curtain or bed valances: other: of synthetic fibers: other other. The duty rate will be 11.6 percent ad valorem.

The applicable subheading for the rubber mat will be 4016.91.0000, HTS, which provides for other articles of vulcanized rubber another than hard rubber: other: floor coverings and mats. The rate of duty will be 2.7 percent ad valorem.

The applicable subheading for the curtain hooks and tension rod will be 8302.41.6050, HTS, which provides for base metal mountings, fittings and similar articles suitable for furniture, doors, staircases, windows, blinds, coachwork, saddlery, trunks, chests, caskets or the like, other, suitable for buildings, other, of iron or steel, of aluminum or of zinc, for curtains. The rate of duty will be 3.9 percent ad valorem.

The shower curtain falls within textile category designation 666. Based upon international textile trade agreements products of China are not subject to quota or visa requirements.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
